Loyalty Program - Terms & Conditions

These Terms & Conditions govern participation in the Loyalty Program ("Program") offered by [Your Company Name Pty Ltd / Business Name] ("we", "us", "our"). By participating in the Program, you agree to be bound by these Terms.

Eligibility
To be eligible to participate in the Loyalty Program, a rider must satisfy all of the following conditions:
- Be at least 18 years of age.
- Hold an active bike rental agreement with us.
- Meet one of the following minimum rental commitments:
- Advance Rental Option: Rent a bike and pay in advance for a minimum period of two (2) consecutive months, or
- Continuous Rental Option: Rent a bike for a minimum of eight (8) consecutive weeks without cancellation, suspension, or non-payment.
- Be fully compliant with the rental agreement, including:
- All payments made on time
- No unresolved breaches, damage claims, or misconduct
- No outstanding fees or penalties
We reserve the right to verify eligibility at any time.

Loyalty Benefit Description
Eligible riders may qualify for a loyalty reward consisting of up to one (1) free rental week per month, awarded to riders ranked in the top 10% of delivery earners, as determined by us.
A maximum of three (3) free rental weeks per calendar year may be awarded per rider under this Program.
The loyalty reward is not transferable, not redeemable for cash, and cannot be exchanged for other services or products.

How the Benefit Is Applied
Any awarded free week is applied as a pro-rated discount, spread evenly across the next four (4) scheduled rental payments following the qualifying month.
No refunds or credits will be issued for past payments.
If the rental agreement ends before all discounted payments are applied, any remaining discount is forfeited.

Earnings Verification & Data Submission
To be considered for the Program, riders must voluntarily submit weekly earnings or billing summaries from supported delivery platforms (including but not limited to DoorDash and Uber).
Submitted information must be:
- Accurate
- Complete
- Unaltered and verifiable
We reserve the right to:
- Request additional documentation
- Reject incomplete, inconsistent, or suspicious submissions
- Exclude riders from the Program if false or misleading information is provided
All data is handled in accordance with our Privacy Policy and applicable Australian privacy laws.

Ranking & Selection
Rankings are calculated monthly, based on earnings data submitted for that period.
Only riders falling within the top 10% of verified earners for the relevant month are eligible to receive the benefit.
Our calculation methodology and ranking decisions are final and binding, subject to Australian Consumer Law.

Exclusions & Disqualification
A rider may be excluded from the Program or have benefits revoked if they:
- Cancel or pause their rental during the qualifying period
- Miss or delay rental payments
- Breach their rental agreement
- Engage in unsafe, unlawful, or abusive behaviour
- Provide false, manipulated, or misleading earnings data
- Attempt to game, exploit, or manipulate the Program

Program Changes & Termination
We may modify, suspend, or terminate the Loyalty Program at any time, acting reasonably and in compliance with Australian Consumer Law.
Changes will not affect benefits already validly earned prior to the change.
Continued participation after changes constitutes acceptance of the updated Terms.

No Guarantee of Earnings or Selection
Participation in the Program does not guarantee:
- Selection into the top 10%
- Receipt of any free rental period
- Any minimum income or delivery earnings
Delivery platform performance is outside our control.

Australian Consumer Law
Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded.

Governing Law
These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the exclusive jurisdiction of NSW courts.

Rental Plans - Terms & Conditions

These Terms & Conditions apply to all bike rental plans offered by AlwaysRide ("we", "us", "our"). By entering into a rental agreement or making any payment, you agree to these Terms.

General Conditions (All Plans)
- You must be 18 years or older to enter a rental agreement.
- All rentals are subject to:
- Identity verification
- Payment authorisation
- Acceptance of our Rental Agreement and these Terms
- All prices are stated in AUD and include GST unless otherwise specified.
- Weekly pricing is charged in advance unless otherwise agreed in writing.
- Bikes remain our property at all times unless and until ownership is explicitly transferred in writing.

Week Rental Plan - $69 per week
2.1 Plan Description
- Weekly rental of an e-bike at $69 per week
- Includes seven-day usage and standard support services
- Designed for riders using the bike most days of the week
2.2 Payment & Billing
- Payments are billed weekly in advance.
- Failure to make payment may result in:
- Suspension of service
- Bike recovery
- Late fees or additional charges as permitted by law
2.3 Cancellation
- You may cancel the Week Rental Plan by providing at least 7 days' written notice.
- No refunds are provided for partially used weeks.
- Any damage, loss, or outstanding fees must be settled before cancellation is finalised.

Rent-to-Buy Plan - $49 per week + $699 down payment
3.1 Plan Description
The Rent-to-Buy plan allows riders to obtain ownership of the bike only after completing all required payments.
The plan consists of:
- A non-refundable $699 down payment
- $49 weekly payments for 52 consecutive weeks
3.2 Ownership
Ownership does not transfer until:
- All 52 weekly payments are made in full
- No outstanding fees, damage costs, or breaches exist
Until ownership transfers, the bike remains our property.
Failure to complete the full term results in no ownership rights, regardless of payments already made.
3.3 Early Termination
If the Rent-to-Buy plan is cancelled or terminated early:
- The bike must be returned immediately
- The down payment is forfeited
- Weekly payments already made are not refundable
We may recover the bike if payments are missed or the agreement is breached.

Plan Changes & Upgrades
Switching between plans is subject to approval and availability.
Any credits, discounts, or loyalty benefits are applied at our discretion and are not guaranteed.
Plan changes do not reset payment obligations unless confirmed in writing.

Damage, Loss & Misuse
You are responsible for the bike during the rental period, including:
- Theft
- Loss
- Damage beyond normal wear and tear
Repair or replacement costs may be charged to you.
Bikes must not be:
- Modified
- Sub-rented
- Used unlawfully or outside intended delivery/commuter use

Service Inclusions & Limitations
Any references to "priority support", "fast swaps", or similar services:
- Are subject to availability
- Do not guarantee immediate replacement
We do not guarantee uninterrupted service or earnings from delivery platforms.

Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (ACL) that cannot be lawfully excluded.
Where permitted, our liability is limited to repair, replacement, or resupply of services.

Program & Pricing Changes
We may update pricing, plans, or features at any time.
Changes will not affect existing agreements unless required by law or agreed by you.
Promotional pricing does not guarantee future availability.

Termination by Us
We may terminate or suspend a rental agreement if you:
- Fail to pay on time
- Breach these Terms
- Provide false information
- Engage in unsafe, abusive, or illegal behaviour
